General Terms and Conditions of Use of the SOCIA platform

I. Introduction

Welcome to SOCIA development inc (hereinafter referred to as, «we», «us» or «the Company»), your activity sharing platform, designed to connect people with similar interests and enrich their experience of discovering and participating in various local activities. By using SOCIA on our website and soon on our mobile applications on iOS and Android, you agree to our Terms of Use (hereinafter «TOU»). These TOU govern access to and use of SOCIA by all, including both individual users and professional entities.

II. Description of Services

SOCIA is much more than just a platform. It's a technological tool for good times in real life. Designed for individuals and entities wishing to discover or promote activities, SOCIA facilitates encounters between enthusiasts and organizers.

For individuals

SOCIA offers you the possibility of proposing or registering for activities free of charge, encouraging exchanges and new friendships.

For entities

highlight your events to an engaged community, thanks to visibility options tailored to your needs.

III. How SOCIA works

Simplicity is our motto. View available activities, find out more about the organizers, find what you're passionate about and join the community. However, a few rules apply to guarantee the quality of our platform:

• Companies, organizations or associations must hold a dedicated subscription and cannot operate as individuals with a free account.
• The creation of paid activities requires a Max account.
• Users under 14 are not allowed to have an account. However, they can take part in activities with their parents, if the latter have reserved an additional place for them.

IV. SOCIA spirit

SOCIA is dedicated to sharing authentic experiences and building friendships, not dating. Inappropriate behavior aimed at seduction or romantic approaches is contrary to our values and will be moderated to maintain the integrity of our community. Mutual respect, compliance with laws and our TOS are essential to ensure a positive experience for all.

We will take any inappropriate attitude in this regard very seriously and will not hesitate to take appropriate action against anyone using SOCIA for other purposes.

V. Account registration and management

A SOCIA account is required to access all our services. You have control over your personal information through your account settings.

User Content

• User Responsibility

  By publishing on SOCIA, you are responsible for your content (texts, images, videos, comments, or other forms of content). It is imperative to ensure that the content does not violate any copyright, trademark, patent or any other intellectual property right or any contravention of the rules set out in these TOU.

• Moderation

  We take the quality of content published on our platform very seriously. SOCIA ensures content quality through automated and manual moderation. Inappropriate content can also be reported by users.

• Consequences

  Publication of inappropriate, defamatory, illegal content, or content that violates our terms and conditions may result in deletion, warnings, or in the case of serious violations, account suspension or deletion.

• General guidelines

  Your content must be relevant and respectful. Offensive behavior, spam and unsolicited advertising are prohibited. Treat other users with respect and courtesy.

Rules of use

Our platform is dedicated to sharing activities and building friendly relationships. In order to maintain a safe and positive experience for all, we have established rules of use that all users must respect. Failure to comply with these rules may result in sanctions, including account deletion.

User types

• Individuals

  Individuals are users who register on the platform primarily for pleasure, discovery and the sharing of common interests. They can choose between free access, which allows them to propose and register for activities, or opt for a premium version offering additional benefits.

• Professionals

  he professionals on SOCIA are those who have a commercial or recurring dimension in the activities they offer. To best meet the needs and realities of professionals, we offer several subscriptions in the «packages» section. Regardless of the formal structure, if your activities are of a commercial nature or take place frequently, you can be classified as a professional.

Authorized and prohibited activities

All activities on SOCIA must comply with Quebec law and our ethical principles. We reserve the right to judge whether an activity complies with our standards.

Specific prohibitions

• Drugs and controlled substances

  Prohibition to promote, sell or consume illicit products. Among other things, gatherings dedicated to consumption are prohibited.

• Gambling

  All forms of betting, gambling, unauthorized lotteries, or the promotion of such games are prohibited. A «poker night with friends» where sums of money are exchanged will be considered prohibited.

• Sexual activities

  any activity with an erotic, pornographic, sexual or romantic connotation is prohibited. An «artistic photography workshop» that turns out to be an erotic photo shoot will not be accepted, nor will a date for two in a romantic setting (restaurant, for example).

• Discriminatory or hateful activities

  any event that promotes hatred, discrimination or violence against a particular group based on race, gender, religion, national origin, sexual orientation or any other protected characteristic. For example, a «discussion group» which, under the guise of freedom of expression, propagates hate speech, could be banned.

• Illegal or dangerous activities

  any event encouraging illegal behavior, violence, self-harm or endangerment of others is prohibited.

• Political demonstrations and rallies

  Political gatherings must be clear in their intentions and respect local laws. Any gathering inciting hatred, violence or civil disobedience without a legal framework is forbidden. For example, a 'freedom rally' that does not clearly state its intentions and could be interpreted as inciting disobedience or illegal actions could be banned.

It is important to note that this list is not exhaustive. We reserve the right to assess and decide at our discretion whether an activity complies with our standards and principles, and we retain the right to modify, suspend or remove an activity.

Additional guidelines:

Users should use good judgment to avoid borderline or inappropriate behavior. We encourage activities that promote positivity, sharing and community enrichment.

User behaviour

• Respect and courtesy:

  Respect for everyone is essential to maintain a friendly atmosphere. Express your disagreements constructively without resorting to insults.

• Harassment:

  All forms of harassment are prohibited. Sending multiple comments on the same activity, even after being asked to stop, is considered harassment.

• Promotion and advertising:

  users are not allowed to use the platform to promote their professional activity or their personal or professional social networks (unless they have a professional subscription that allows this).

• Activities of an ambiguous nature:

  activity descriptions must be clear and unambiguous to avoid any confusion about their nature. If you're offering a «movie night at home» on our platform, be sure to specify the type of film, the expected atmosphere, and the target audience (families, adults only, etc.). A vague description can raise questions and make some people suspicious of the true nature of the event (including our moderators).

• Financial solicitation:

  Asking or soliciting money from other users, unless directly related to a pre-approved paid activity, is prohibited. This includes any form of begging or asking for donations unrelated to a specific activity.

• Unauthorized commercial activities:

  It is forbidden to use the platform to sell goods or services that are not directly related to an activity or experience. This includes product promotion, MLM (Multi-Level Marketing) or any other form of unsolicited advertising.

• Misrepresentation:

  misrepresenting oneself, publishing incorrect information, and spamming are strictly prohibited.

• Integrity and use of the platform:

  Any misappropriation or unauthorized modification of SOCIA will result in severe penalties. We accept no responsibility for unauthorized interference with the normal operation of the platform. Any such action may result in the immediate suspension or definitive termination of access to the platform for the user concerned, without prejudice to any legal action that SOCIA may take. If, as a result of such unauthorized interference, the platform ceases to function normally, SOCIA declines all responsibility and shall not be liable to repair or compensate for the consequences of such actions.

Each user is responsible for his or her actions and must always behave in a way that respects and does not harm other members of the community. Repeated violations of these rules may result in sanctions, including account deletion.

Use of pictures and comments

• Images:

  Users are encouraged to share images that illustrate or enhance their activities. However, they must be suitable for all ages. It is forbidden to share images featuring nudity, sexually suggestive content, promoting violence or discrimination, or violating privacy and intellectual property rights.

• Comments:

  Comments are a way for users to share their experiences, ask questions and interact with other members. Comments should be respectful and constructive. Comments must not be abusive, discriminatory, defamatory, contain unsolicited advertising, disclose private information, or be misleading.

VI. Property rights

• SOCIA property

  All source code, design, text, graphics, interfaces, and other visual or audio content of the platform, as well as their selection and arrangement, is the exclusive property of SOCIA. The use of SOCIA does not grant you any ownership rights to these elements.

• Respect for copyright

  any content uploaded, posted or displayed by users must respect copyright and other intellectual property rights. It is the responsibility of each user to ensure that they hold the necessary rights or have obtained the appropriate permissions for the content they publish on the platform.

• Third-party licenses

  SOCIA uses certain images or shapes provided by CANVA, in accordance with their regulations. In addition, generic images used for non-photo activities come from Pixabay and are used in accordance with their terms and conditions.

• Prohibited use

  unless expressly authorized in writing by SOCIA, it is forbidden to copy, modify, publish, download, distribute, publicly perform, reproduce or create derivative works from the content of the platform.

• Reporting copyright infringement

  If you believe that content on our platform infringes your or a third party's copyright, we encourage you to report it to us immediately. We will take appropriate steps to review and, if necessary, remove the content in question.

VII. Limitation of Liability

• Technical malfunctions

  Although SOCIA strives to provide a stable and functional platform, we do not guarantee uninterrupted or error-free availability. We cannot be held responsible for any technical malfunctions, errors, interruptions or delays that may occur, whether due to internal or external causes, or to third parties with whom we collaborate.

• Consequences of malfunctions

  in the event of a technical malfunction leading to the cancellation of an activity, or if a user cancels his or her participation in a professional activity less than 24 hours before it begins due to technical problems on our platform, we undertake to do everything necessary to reimburse the costs incurred.

• Exclusions

  We will not be liable for indirect, consequential, exemplary, incidental, special or punitive losses, including loss of profits, even if we have been advised of the possibility of such losses.

• External links and third-party content

  Our platform may contain links to other websites or online resources. We are not responsible for the content, advertising, products or other materials available on these external sites and resources. Any risk associated with the use of these external sites or resources is fully the responsibility of the user.

VIII. Modifications to the GCU

We reserve the right to modify these TOU at any time without notice. However, we undertake to inform users of any substantial modification. The information will be communicated at the time of the next connection to the platform or by another appropriate method.

Your continued use of our platform following these changes constitutes your acceptance of these new terms. If you do not agree with the changes to our TOS, you should stop using our platform.

We encourage you to periodically visit this page to review any changes or updates to our TOU.

IX. Applicable law and jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. They are subject to the exclusive jurisdiction of the Quebec courts.

In the event of any dispute, conflict, claim or controversy arising out of or relating to these T&Cs or the use of our platform, we first encourage an attempt at amicable resolution. If such resolution is not possible, the dispute may be submitted to the competent courts of the province of Quebec.

Although we favor the amicable resolution of disputes, the parties may agree to resort to arbitration to resolve any dispute. In this case, arbitration will be conducted in accordance with the Arbitration Rules of the Arbitration Institute of Quebec (or another mutually agreed arbitration body). The arbitration will be held in Chicoutimi, Quebec, or at any other location mutually agreed upon by the parties. It should be noted that the decision to resort to arbitration must be made by mutual agreement between the parties after the dispute has arisen.

To the extent permitted by law, the parties waive their right to bring or participate in a class action or any other type of representative proceeding. This waiver will be subject to the discretion of the competent court or arbitration body.
